A recent decision of the Alberta Court of Appeal confirmed Justice Erb’s decision of the Court of Queen’s Bench. Connor Glynn successfully argued at both levels of Court that the property owner Riocan was entitled to a full defence by Intact Insurance with respect to allegations in a civil claim regarding a slip and fall on Riocan’s property. The decision relieves Riocan of having retain its own counsel in the civil lawsuit – Riocan will now be defended by Intact.
